Trademark registration is governed by the Trade Marks Ordinance 2001. The procedure includes: (a) trademark search at IPO Pakistan, (b) filing of application with prescribed forms and fees, (c) examination by the Registrar for distinctiveness and conflicts, (d) publication in the Trademarks Journal, (e) opposition period of 2 months from publication, (f) registration and issuance of certificate. The registration is valid for 10 years and renewable indefinitely. Foreign applicants must file through a local registered agent.
Copyright is protected under the Copyright Ordinance 1962. Protection is automatic upon creation of the work in a tangible form under Section 3. Registration is voluntary but recommended for enforcement under Section 43. Works covered include literary, artistic, musical, dramatic works, films, sound recordings, and computer programs under Section 2. Copyright lasts for the life of the author plus 50 years under Section 14. Performers' rights and broadcast rights are also protected.
Trademark infringement cases are filed in civil courts under Section 46 of the Trade Marks Ordinance 2001. The plaintiff must prove: (a) ownership of registered trademark, (b) use by defendant in the course of trade, (c) likelihood of confusion or deception among consumers. Remedies under Section 54 include injunction, damages, delivery up of infringing goods, and account of profits. The court may also grant an Anton Piller order for search and seizure. Criminal prosecution is also available under Section 52.
Under the Copyright Ordinance 1962, criminal prosecution for copyright infringement must be filed within 3 years of the offense under Section 65. Civil suits for infringement must be filed within 3 years under Article 120 of the Limitation Act 1908. Injunctions may be filed at any time during the infringement. The limitation period starts from the date of knowledge of the infringement under Section 18 of the Limitation Act.
Trademarks are governed by the Trade Marks Ordinance 2001 and Trade Marks Rules 2004. Copyright is governed by the Copyright Ordinance 1962 and Copyright Rules 1967. Patents are governed by the Patents Ordinance 2000. Designs are governed by the Registered Designs Ordinance 2000. The Intellectual Property Organization (IPO) of Pakistan is the administrative authority. Civil courts and High Courts have jurisdiction over IP disputes under the respective ordinances.
