Property arbitration is an Alternative Dispute Resolution (ADR) process where property disputes are resolved by an arbitrator instead of going to court. It is governed by the Arbitration Act 1940. The arbitrator hears both parties and issues an award. Under Section 17 of the Act, the award can be made a decree of the court and is enforceable as a court judgment. Arbitration is faster, cheaper, and less adversarial than litigation.
Initiate arbitration by referring the dispute to an arbitrator named in the property agreement or through a separate arbitration agreement. Under Section 8 of the Arbitration Act 1940, the court can appoint an arbitrator if the parties cannot agree. The arbitrator must give notice to both parties, hear their evidence, and issue an award.
